Ramboll successfully supported a legal claim against an indemnity agreement, setting the groundwork for environmental cost recovery negotiations.
Ramboll was retained by a confidential client in 2019 to support the filing of a claim against an indemnity agreement for impacts at a former fire-fighting foam manufacturing facility in the United States.
Changing processes and chemistry
Ramboll provided third party review of site investigation data and data for an adjacent off-site property, conducted a site reconnaissance visit, conducted interviews with knowledgeable company representatives to understand the foam manufacturing process, how the process had changed over time and how the chemistry of the foam had changed over time.
Ramboll subsequently prepared a Technical Report of Opinions relating to releases of per- and polyfluoroalkyl substances (PFAS) and other contaminants at the site.
Results that matter
Our work enabled us to provide opinions relating to releases of hazardous substances at the site, whether such releases resulted in a breach of environmental law, and the costs to bring the site into compliance with environmental law in support the claim.
Ramboll’s work resulted in successful negotiation of a cost sharing agreement.
